1. Who we are
This website and the iberfence.com online shop belong to Iberfence, S.L., VAT/Tax ID B74417890, with registered office at Av. de La Fontona, 33429 Siero (Asturias), Spain, registered in the Companies Register of Asturias, volume 4223, folio 80, sheet AS-50410, and with EU VAT number ESB74417890. 2. Scope
These terms govern purchases made on iberfence.com by consumers (people buying for purposes outside their trade or profession) and by businesses and professionals. Where a clause applies to only one of them, this is expressly stated. By clicking the payment button, the customer confirms having read and accepted these terms. The contract is concluded in Spanish and the customer receives the order confirmation by email.
3. Prices and taxes
Product prices are shown excluding VAT (“+ VAT”). Before payment, the basket shows the final total price, including the taxes and shipping costs that apply to the destination. Shipping costs follow the same VAT treatment as the goods. VAT is determined by the delivery address:
- Mainland Spain and the Balearic Islands: Spanish VAT (21%).
- Consumers in other European Union countries: VAT of the destination country, which Iberfence pays through the One-Stop Shop (OSS).
- Businesses in other EU countries with an intra-community VAT number that is valid in VIES at the time of the order and delivery to an EU country other than Spain: VAT-exempt intra-community supply (art. 25 Spanish VAT Act 37/1992). If the number cannot be validated, the order is charged the applicable VAT and is not changed afterwards except by a justified corrective invoice. A Spanish tax ID does not qualify for the exemption, even if delivery is to another EU country.
- Canary Islands, Ceuta, Melilla, territories outside the EU VAT area and non-EU countries: export exempt from Spanish VAT (art. 21 Spanish VAT Act 37/1992). See section 5.
4. Order and payment
Payment methods: those shown on the checkout page at any given time. The order is prepared once payment has been received, unless otherwise agreed with businesses. The invoice is issued in the name given in the order; to receive a full invoice as a business, enter the company name and tax ID or VAT number in the corresponding fields.
Iberfence may cancel an order and refund the full amount immediately in the event of an obvious pricing or system error, or if the product has sold out due to a simultaneous sale. The customer will be informed before cancellation.

United Kingdom: due to UK VAT rules, we do not accept orders from consumers for delivery to Great Britain where the value of the goods is £135 or less. Shipments to Northern Ireland follow European Union rules.
Delivery times shown for each product are approximate. Unless another period is stated, we deliver within 30 days of the order. If this is not met, the consumer may set a reasonable additional period and, if delivery still does not take place, terminate the contract and receive a full refund (art. 66 bis of Spanish Royal Legislative Decree 1/2007). For consumers, the risk of loss or damage passes to the customer on receipt of the product. Please check the parcel on delivery and note any visible damage on the carrier’s delivery note.
6. Right of withdrawal (consumers only)
Consumers may withdraw from the contract without giving any reason within 14 calendar days from the day on which they, or a third party other than the carrier indicated by them, receive the product (arts. 102 to 108 of Spanish Royal Legislative Decree 1/2007). If the order contains several products delivered separately, the period starts from receipt of the last one.
To exercise it, inform us of your decision by an unequivocal statement (for example, an email to social@iberfence.es), stating your name, address and order number. You may use the model withdrawal form at the end, but it is not compulsory. It is sufficient to send your communication before the period expires.
Effects: we will refund all payments received, including the initial delivery costs (except the extra cost if you chose a delivery method more expensive than the standard one), within 14 calendar days of being informed of your decision, using the same means of payment unless you agree otherwise at no cost to you. We may withhold the refund until we have received the product or you have supplied proof of having sent it back.
You must return the product within 14 calendar days of your communication. You bear the direct cost of returning the goods; for bulky products or products over 2 kg that cannot be sent by normal post, the estimated cost is the carrier’s rate for that weight and destination, which we will tell you on request. You are only liable for any diminished value of the product resulting from handling beyond what is necessary to establish its nature, characteristics and functioning.
Exceptions (art. 103): products made to the customer’s specifications or clearly personalised, and sealed products which are not suitable for return due to health protection or hygiene reasons and which have been unsealed after delivery.
The right of withdrawal does not apply to purchases made by businesses or professionals.
7. Warranty (see conditions)
Consumers: products carry the statutory guarantee of conformity of 3 years from delivery (art. 120 of Spanish Royal Legislative Decree 1/2007), without prejudice to any more favourable rights granted by the law of your country of residence in the European Union (EU legal minimum: 2 years). During this period the consumer may choose between repair or replacement and, where applicable, a price reduction or termination of the contract. Iberfence keeps spare parts and technical service available for 10 years after the product is discontinued.
Businesses and professionals: the warranty is 1 year from delivery and covers the repair or replacement of parts with manufacturing defects. It does not include travel, labour at the customer’s premises or loss of profit. The buyer must inspect the goods on delivery and report visible defects within 4 days (art. 336 of the Spanish Commercial Code).
Engines of third-party brands also carry their manufacturer’s warranty, handled through its official service network. The warranty does not cover normal wear, misuse, failure to carry out the maintenance set out in the manual, or repairs or modifications made without Iberfence’s authorisation.
To make a warranty claim, write to social@iberfence.es with the order number, a description of the problem and, if possible, photos or video. Products sent in under warranty do not constitute a new sale.
8. Complaints
You can send any complaint to social@iberfence.es or call +34 985 985 351; official complaint forms are available to consumers. We will reply as soon as possible and within one month at the latest. If you are not satisfied, you may contact the consumer protection services of your region or country.
9. Governing law
These terms are governed by Spanish law. For consumers, this is without prejudice to the mandatory rules of their country of residence and the jurisdiction granted to them by law. For businesses and professionals, the parties submit to the courts of Siero (Asturias, Spain), the registered office of Iberfence, S.L.
